Engineer Walks Free After Stealing Thousands of Fi

Former Intel product marketing engineer Varun Gupta, who stole "thousands of files," was sentenced to two years of probation and a $34,472 fine. The confidential documents helped him secure a new role at Microsoft and were used in Microsoft’s processor procurement negotiations with Intel.

Gupta, who spent 10 years at Intel, joined Microsoft directly after leaving in January 2020. He copied large volumes of secret files before departure, including a PowerPoint listing Intel’s pricing strategies for major clients.

U.S. prosecutors sought an 8-month prison term, emphasizing his repeated intentional acquisition of confidential materials. But defense lawyers framed it as a "serious error in judgment," citing mitigating factors: loss of senior industry opportunities and a $40,000 civil settlement with Intel.

U.S. District Judge Amy Baggio ruled for probation, with the fine equaling the cost of 8 months in federal prison. She noted the penalty reflects the non-accidental nature of his actions, while his damaged reputation is also punitive.

Gupta must pay the full fine before returning to France, where he plans to restart his career at a "beautiful French" winery, pursuing vineyard management qualifications to become technical director.
