Chinese RF Chipmaker Kangxi Communication Wins Key 337 Case Against Skyworks

On January 25, Kangxi Communication (688653) released a major announcement disclosing the latest progress in a 337 investigation and patent litigation involving its subsidiaries—a highly encouraging development for the industry. The company has completely prevailed in its multinational patent dispute with global RF leader Skyworks, with a ruling that it did not infringe any of the asserted patents, successfully breaking through overseas patent barriers and setting a benchmark for other domestic RF companies expanding internationally.

The announcement states that on January 24 (Beijing time), the company formally received the initial determination by the U.S. International Trade Commission (ITC) Administrative Law Judge, which found that Kangxi Communication Technology (Shanghai) Co., Ltd., GRAND CHIP LABS, INC., and related entities did not violate Section 337 of the Tariff Act of 1930 and did not infringe Skyworks’ patents US 9,917,563 and US 8,717,101.

Of the three patents originally asserted by Skyworks in this 337 investigation, two had already been withdrawn by Skyworks itself. With this latest ruling, Kangxi Communication has been cleared of infringing all five patents Skyworks had raised, marking a major interim victory in an 18‑month cross‑border intellectual‑property dispute. The conflict began in May 2024 when Skyworks first sued Kangxi for infringement, followed by a 337 investigation petition in July 2024 in an attempt to curb its overseas expansion.

In August 2024, Kangxi Communication was notified that the ITC had instituted an investigation. The company remained composed throughout, strictly followed 337 procedures, assembled a professional defense team, and built a dual defense of “legal advocacy + technical analysis” to fully protect its legitimate rights.

Regarding the favorable outcome, Kangxi stated that as a professional RF front‑end chip design company, it consistently emphasizes IP management and protection, adheres to independent innovation, and possesses an independent and complete intellectual‑property system. The company also strictly implements pre‑implementation IP screening and risk‑warning mechanisms to ensure technological autonomy and operational compliance. The initial win in the 337 investigation signifies that the company’s products now have critical legal support for export to the U.S. market, clearing a major obstacle for its global expansion.

Kangxi Communication noted that this 337 ruling is an initial determination and that subsequent review and a final ruling will follow; the company will continue to monitor and actively respond to protect its own and its shareholders’ interests. On the performance front, the company’s revenue for the first three quarters of 2025 exceeded its full‑year 2024 revenue (full‑year 2025 figures are still being audited), with Wi‑Fi 7 and broad IoT businesses expected to support steady revenue growth. Beyond preserving its U.S. market access, the victory demonstrates the innovation strength of domestic integrated‑circuit companies and provides a reference for other Chinese RF firms facing overseas IP challenges.
