Samsung's Key HBM and DDR5 Memory Products Under U.S. Import Ban Investigation

A significant patent dispute has escalated to a potential trade barrier. The U.S. International Trade Commission (ITC) has voted to launch an investigation into Samsung Electronics, along with its customers Google and Super Micro, over allegations of patent infringement. The investigation specifically targets Samsung's crucial High Bandwidth Memory (HBM) and DDR5 memory products. If infringement is confirmed, the ITC could issue exclusion and cease-and-desist orders, effectively blocking these products from the U.S. market—a move that would significantly impact the global memory supply chain.

The complaint was filed by Netlist, a California-based company founded in 2000, which holds 210 global patents in areas like hybrid memory and storage-class memory. Netlist alleges that Samsung's HBM and DDR5 products infringe on several of its core technology patents. Notably, this is not the first legal battle between the two companies. In 2023, a jury found Samsung liable for infringing Netlist's patents related to DDR4 and DDR5 memory, awarding Netlist $303 million in damages.

Netlist's CEO, Chun-Ki Hong, stated the company welcomes the ITC's decision and will take firm action to protect its intellectual property. Samsung has not yet publicly responded. Given the explosive demand for HBM driven by AI and the widespread adoption of DDR5, a successful outcome for Netlist could disrupt Samsung's business in a key market and affect the supply chains of major customers. The ITC is expected to set a target date for completing the investigation soon.
